The patient's right to third person presence in healthcare facility

Resumé This thesis discusses the problematics of third person presence alongside a patient in a healthcare facility. Despite this subject having been relevant for tens of years, it has only recently been brought to public attention due to the COVID-19 pandemic. In practice, the right to third person presence in accordance with the provisions of Article 28(3e) of the Health Services Act is commonly misinterpreted as the right to receiving visitors in accordance with the provisions of Article 28(3i) of the Health Services Act. Due in part to this fact, the main goal of this thesis is establishing legal clarity in this domain of healthcare law. The bulk of this paper consists of introduction and analysis of legislation, notably the Health Services Act, in light of international pacts and laws of the Czech Republic, on constitutional level but not limited to it. The most crucial, however, is Chapter 3, which discusses specific provisions of the Healthcare Services Act concerning the right to presence, specifically the provisions of Article 28 of this Act. Load and Support for Next-of-kin Caregivers

This diploma thesis deals with the topic of informal caregivers. The work is divided into two parts. The theoretical portion will take us through general information about caregivers, quality of life, the complexity of care and the offer of assistance to people caring for a family member or other loved one. The topics of stress, needs and support of informal caregivers are elaborated in more detail, and the topic of social policy and its principles and functions is also further explored. The work emphasizes the importance of systemic support for all caregivers of a loved one. In the research portion, this diploma thesis presents the experiences and situations of individual participants. The author has used the method of qualitative research in this study. In this diploma thesis, the research sample consisted of twelve persons from the Czech Republic and three persons from abroad (from the Federal Republic of Germany, the Republic of Austria and the Slovak Republic). The information obtained from foreign participants serves to illustrate the positions of informal caregivers in neighboring countries. Compensation for a non-pecuniary harm of secondary victims

This final thesis "Compensation for a non-pecuniary harm of secondary victims" deals with the issue of secondary victims. A secondary victim is defined as an injured person who suffered a non-pecuniary harm as a consequence of what happened to another person (primary victim) to which the tortfeasor caused imminent harm. I focused exclusively on secondary victims under the section 2959 of Czech Civil Code. The section 2959 of Czech Civil Code enables secondary victims to require a monetary compensation for the harm which they suffered as a consequence of a death or a serious injury of their close person (primary victim). Within the analysis of section 2959 of Czech Civil Code I described the nature of a harm suffered by the primary victim, the circle of eligible secondary victims and the quality of their harm, as well as the extent of the compensation for the harm of secondary victims. Doing so, I used the comparative method. I compared the legal regulation of the Czech Civil Code with the former Czech regulation and corresponding decisions of Czech courts. Use of Care Allowance in District of Trhové Sviny

Abstract An allowance fot the care is rather a new institute which is the main implement of the model of social services established 1/1 2007 on the basis of the law 108/2006 Statute Book about social services. This contribution relates to providing social services. The creation took 13 years and brought many amendments to this sphere ? not only a new conception of social services, their kinds, forms and conditions of providing, it also introduced a new approach to financial source for persons who need it in their unfavourable situation. Current allowance in the process of the care for a close or other person was replaced with an allowance for the care. The aim of this work is a mapping of offers of the social services in the territory of Trhové Sviny and to find if beneficiaries of these allowances for the care use more an assistance providing by the close person or by a registered provider of social services. The results of this research point out that in most cases the assistance of the close person is used. This dissertation could be used for a community planning and as an information material for Sviny´s inhabitants and providers of the local social services.
